Recording Consent Notice

SpotWhisper enables you to record customer conversations for the purpose of transcription, AI-powered data extraction, and CRM synchronization. Recording conversations carries legal obligations that vary by jurisdiction. This notice outlines your responsibilities.

Your Responsibility

As the user initiating a recording through SpotWhisper, you are solely responsible for:

  • Obtaining consent from all parties to the conversation before recording begins
  • Ensuring your use of recordings complies with all applicable federal, state, and local laws
  • Informing recorded parties of the purpose of the recording
  • Deleting recordings that are no longer needed or that must be removed in response to a data subject request

Two-Party Consent States

In the United States, several states require the consent of ALL parties to a conversation before it may be legally recorded. These "two-party consent" (or "all-party consent") states include:

California, Connecticut, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, Washington

And others. Recording without all-party consent in these jurisdictions may constitute a criminal offense. If you or the person you are speaking with is located in a two-party consent state, you must obtain their explicit consent before recording.

International Considerations

If you record conversations with individuals located outside the United States, additional privacy laws may apply, including the EU General Data Protection Regulation (GDPR) and the UK Data Protection Act. Under these laws, recording without a lawful basis (such as explicit consent) may violate data protection requirements.

How SpotWhisper Handles Recordings

  • Raw audio files are automatically deleted 30 days after creation
  • Transcripts and AI-extracted data are retained while your account is active
  • You may delete any recording at any time from your dashboard
  • SpotWhisper does not monitor the content of your recordings
